Mediation is the intervention in a dispute or negotiation of an acceptable impartial and neutral third party, who has no decision-making authority. The objective of this intervention is to assist the parties in reaching a mutually-acceptable resolution of the issues in dispute.
A mediator often works with the parties individually, in caucuses, to explore acceptable resolution options or to develop proposals that might move the parties closer to resolution.

 

What is alternative dispute resolution?
Alternative dispute resolution (ADR)
is a process in which a neutral third party-a mediator or arbitrator-helps parties who are embroiled in a dispute come to an agreement. Alternative Dispute Resolution is the process of solving disputes without litigation.

A neutral is defined as a person whose function is to aid the parties in resolving the issue in controversy. A neutral shall have no official, financial, or personal conflict of interest with respect to the issues in controversy, unless such interest is fully disclosed in writing to all parties and all parties agree that the neutral may serve. In order to be effective, the participants in an ADR proceeding must perceive the neutral as completely impartial.
